§1 DEFINITIONS

Terms written with capital letters in these Terms and Conditions shall have the following meanings unless the context indicates otherwise:

Store – the online store available at pulpashop.com
Products – all items offered for sale in the Store
You (Customer/User) – a person using the Store
Terms and Conditions – these Terms and Conditions
Sales Agreement – an agreement concluded between the Customer and the Store. The agreement is governed by the Act of 2 March 2000 on the protection of certain consumer rights and liability for damage caused by dangerous products.

§2 GENERAL INFORMATION

Using the Store requires reading and accepting these Terms and Conditions.

These Terms and Conditions are addressed to the Store’s Customers and define the rules for placing orders and concluding Sales Agreements.

The Store enables the purchase of Products online at:
pulpashop.com

Information about Products available in the Store, including descriptions and prices, constitutes an invitation to submit an offer to conclude a Sales Agreement within the meaning of Article 71 of the Polish Civil Code.

Photos and presentations of Products are illustrative and are intended to present specific models.

Products available in the Store are clearly described. Customers have access to information regarding product properties, prices, materials, and other relevant details.

Customers using the Store are obliged to:

  • Use the content available on the Store’s website solely for personal use
  • Use the Store in accordance with the laws applicable in the Republic of Poland and these Terms and Conditions

§3. NEWSLETTER 

Users may subscribe to the Newsletter service. By subscribing, the Customer agrees to:

  • Receive commercial information from the Store within the meaning of Article 10(2) of the Act of 18 July 2002 on the provision of electronic services, sent to the email address provided during registration
  • Allow the Store to collect and process personal data for marketing purposes in accordance with the Act of 29 August 1997 on the protection of personal data

The Store, as the administrator of all personal data provided by Customers, ensures its protection in accordance with applicable law.

Newsletter distribution is automated through the MailChimp platform. By subscribing to the newsletter, the User consents to transferring their personal data to MailChimp in accordance with MailChimp’s Privacy Policy and Terms of Service. MailChimp is certified under the EU–U.S. Privacy Shield Framework and complies with GDPR requirements.

Customers may unsubscribe from the newsletter at any time by clicking the unsubscribe link included in every email message.

§4 CONCLUSION OF THE SALES AGREEMENT

Customers may conclude a Sales Agreement by placing an order through the Store website. The agreement is concluded between the Customer and the Store.

Orders may be placed 24 hours a day, seven days a week. Orders placed on public holidays or non-working days will be processed on the next working day.

To place an order, the Customer must provide the data required for delivery and for issuing the invoice.

To place an order, the Customer must:

  • select Products from the Store’s offer
  • choose their color, size, and quantity
  • add them to the Shopping Cart

Until the order is confirmed by clicking “Place order”, the Customer may modify the Products or their delivery and billing details.

Submitting an order constitutes an offer by the Customer to conclude a Sales Agreement under these Terms and Conditions.

After placing an order, confirmation will appear on the Store website and an email will be sent containing:

  • ordered Products
  • order value
  • selected delivery method
  • selected payment method
  • Customer contact details

This email confirms receipt of the Customer’s offer.

The Customer will then receive confirmation that the order has been accepted for processing. At that moment the Sales Agreement is concluded.

The Sales Agreement is concluded under the terms set out in these Terms and Conditions.

Customers may cancel their order before receiving confirmation that the order has been accepted for processing by contacting the Store via email.

Customers also have the right to withdraw from a remote purchase within 14 days, in accordance with the Consumer Rights Act of 30 May 2014.

The Store reserves the right to refuse order fulfillment if:

  • the Customer’s contact details are incorrect
  • payment authorization fails in the przelewy24.pl system
  • payment is not made within the specified time

§5 DELIVERY AND COLLECTION

The order fulfillment time indicated during the ordering process is the estimated time required to complete the order. In exceptional situations, this time may be confirmed by a Store employee via email or telephone.

Products are delivered by the courier company InPost to the address provided by the Customer.

Delivery costs are indicated during the checkout process.

Estimated delivery time is 1 working day from the day following shipment.

The maximum order fulfillment time should not exceed 14 working days, and in any case no later than 30 days from the date of the Sales Agreement.

Order processing begins after the Store receives payment through the selected payment system (przelewy24.pl or bank transfer).

Upon receiving a parcel from the courier, the Customer should inspect the package and its contents in the presence of the courier. If damage is identified, the Customer should prepare a damage report together with the courier.

If the “In-store pickup” option is selected, the order will be available for collection at:

during the store’s opening hours.

Orders will be ready for pickup within up to 14 working days after payment, and the Customer will be notified by email.

Orders not collected within one week may be cancelled by the Store.

A valid ID matching the order details may be required to collect the order.

If a domestic shipment is not collected from the courier or parcel locker and is returned to the sender, the Customer agrees to cover:

  • the original shipping cost
  • the return shipping cost (18 PLN)

The parcel may be sent again after the Customer confirms and pays the standard shipping fee.

For international shipments, the Customer must also cover the original shipping cost and return shipping cost, which may vary depending on destination and customs charges.

§6 SALES, PRICES AND PAYMENTS

The price of a Product displayed in the Store becomes binding at the moment the Customer receives confirmation that the order has been accepted for processing.

Prices will not change after that moment even if prices change later in the Store.

All prices are gross prices (including VAT).

  • In the Polish version of the Store they are listed in PLN
  • In the English version they are listed in EUR

Customers may change the currency to EUR by selecting the English language version.

Payment methods available:

  • electronic payment via przelewy24.pl
  • traditional bank transfer before delivery

Order processing begins after payment is received.

The Store reserves the right to:

  • change Product prices
  • introduce new Products
  • run or cancel promotions
  • modify promotions

These changes will not affect orders already confirmed.

§7 WARRANTY, RETURNS AND COMPLAINTS

The Store, as the seller, is responsible to consumers for any lack of conformity of the Product with the Sales Agreement under the applicable Polish consumer law.

All Products offered in the Store are new.

Because many Products are handmade and made from unique materials, slight differences in appearance may occur.

Products made to order or according to individual Customer specifications are not eligible for return or exchange.

Products purchased in the Store may be subject to complaint if they are defective.

The Store will inform the Customer about the outcome of the complaint within 14 days of receiving the product.

If the complaint is accepted:

  • the Store will repair or replace the product within 20 working days, or
  • if that is not possible, the Store will refund the full purchase price.

If the complaint is rejected, the product will be returned together with an explanation.

Customers have the right to withdraw from the Sales Agreement within 14 days of receiving the product without providing a reason.

To do so, the Customer must send an email to:

within 14 days of receiving the product.

Returned items must be:

  • unused
  • clean
  • free from odors
  • with original tags attached

Refunds will be made within 14 days after receiving the returned product.

Refunds will be issued to the Customer’s bank account or, if the payment was made by card, to the same card.

The Store may refuse a return if:

  • the product is damaged
  • the return is sent after the deadline
  • the item is incomplete

Products made on special request cannot be returned or exchanged.

The Store does not accept cash-on-delivery returns.

If returned parcels sent from outside the EU are subject to customs duties or other charges, these costs will be deducted from the refund.

§8 GIFT CARDS

General provisions

Gift cards may be used:

These terms apply to gift cards purchased in the Store.

  • online at pulpashop.com
  • in the physical store at Plac Nowy Targ 10 in Wrocław.

Gift cards may be used to pay for all or part of an order.

If the gift card value is lower than the purchase amount, an additional payment method may be used.

Gift cards can be used only once.
Unused funds are not refunded.

Validity period

Gift cards are valid for 1 year from the purchase date.

Delivery

Physical gift cards are delivered within 2–5 working days in Poland by courier.

Customers must provide a correct delivery address.

Gift cards may also be delivered digitally via email.

Returns

If products purchased with a gift card are returned, the Customer will receive:

  • new e-gift card, and
  • a refund of any additional payment used.

Gift cards cannot be exchanged for cash.

Cancellation

Customers have 14 days to cancel an unused gift card purchased online.

To cancel a gift card, contact:

Limitation of liability

The Store is not responsible for lost, stolen, or damaged gift cards. Gift cards should be treated like cash.

§9 PRIVACY POLICY

Use of personal data

Personal data is protected against unauthorized access, modification, or destruction using appropriate technical and organizational measures.

The Store uses cookies.

Cookies are small text files stored on the User’s device and used for:

  • generating statistics about website usage
  • confirming that Users have read the cookie information

Users may disable cookies in their browser settings, although this may affect some website functions.

Sharing personal data

Personal data may be shared with:

  • przelewy24.pl – payment processing
  • DPD – delivery services
  • MailChimp – newsletter management

International data transfer

Our servers are located within the European Union.

Personal data may be transferred to payment systems, courier companies, and analytics platforms, all of which comply with EU data protection standards.

Data storage

Personal data is stored only as long as necessary.

  • Transaction records are stored for at least 5 years for legal purposes
  • Newsletter data is stored until the User unsubscribes
  • Waiting list data is stored until the product becomes available

Your rights

You may request access to the personal data we hold about you.

You may also request that your data no longer be used for marketing purposes.

§10 FINAL PROVISIONS

Customer personal data provided during orders is processed solely for order fulfillment.

By placing an order, the Customer agrees to these Terms and Conditions.

Polish law governs all Sales Agreements concluded through the Store.

Any matters not regulated by these Terms and Conditions shall be governed by the Polish Civil Code and other applicable laws.

The competent court for dispute resolution shall be the court with jurisdiction according to applicable regulations.

The Store reserves the right to amend these Terms and Conditions at any time. Changes take effect once published on the Store’s website.

All photographs, graphics, logos, publications, and texts available in the Store are protected by copyright law. Unauthorized copying or distribution is prohibited.
